WARNING: You must be 18 years of age or older at the time you place your order to enter this raffle. Void where prohibited by law. I have read these Terms and Conditons for the “Raffle.” I understand that the Raffle is being conducted by The Austin Education Foundation, Inc (AEF) and that participation and entering my contact information, equivalent to my written signature, on the raffle entry page that I am (a) affixing my electronic signature , and (b) certifying that I have read and agree to these terms and conditions.
Raffle Period. The raffle period will be listed on the raffle page. The raffle will run from the start date through to the end date or until all raffle tickets are sold, whichever occurs first. AEF reserves the right at is sole discretion to end a raffle at any time as it may desire.
Eligibility: Eligible individuals who are at least eighteen (18) years of age at the time of entry and reside within the contiguous 48 states of the United states of America may purchase raffle tickets for this Raffle. In addition, anyone deemed by AEF, in its sole discretion, to be in the position to create even a perception of having an undue influence on the results of the Raffle, whether or not any such undue influence actually exists, is not eligible to participate and win. This Raffle is subject to all applicable federal, state and local laws, rules and regulations and is void where prohibited or restricted by law, rule or regulation. AEF raffles are registered with and conducted under the laws of SC.
Prizes. Prizes will be listed on the raffle page. Where it may be diffucult or unreasonable, in the opinion of AEF, to deliver a raffle prize to a winner, AEF may elect, at it's sole discretion, to award a comparable cash value prize to the raffle winner.
Taxes: As we understand it, the Internal Revenue Service takes the position that no portion of the ticket price will qualify as a charitable contribution for income tax purposes. Moreover, the Internal Revenue Service and the South Carolina Department of Revenue, the jurisdiction in which this Raffle is being conducted, treats the value of prizes won in a raffle as income for tax purposes. Depending on his/her personal circumstances, the raffle winner may or may not be required to pay additional taxes to the Internal Revenue Service and/or the the State of South Carolina and/or your state of residence. Any taxes that may be due are the sole responsibility of the winner. Please consult with your tax advisor to determine what your personal tax liability would be should you win the Raffle.
How To Enter. Raffle tickets are only availabe for purchace online through www.rafflecreator.com. On each raffle page, a link will be provided for direct access to the raffle page hosted on rafflecreator.com. Each entrant will receive their raffle ticket numbers electronically via email. A valid email address is a requirement for entering any of the AEF raffles.
Winner Selection. The winner will be selected electronically through rafflecreator.com and their random ticket number generator.
Winner Notification. The winner will be notified electronically by email and/or contacted by phone when a phone number is provided. The winners name will be posted on the AEF Facebook page as quickly as possible. Winner will have 14 days to claim the prize. Failure to claim the prize within 14 days will result in a second/replacement winner being selected.
Claiming The Prize. AEF will endevor to ship or deliver the prize to winner. However, larger prizes such as vehicles will require travel on the part of the winner. Some prizes may require winner to pick up the prize at the AEF offices or designated location. Travel expenses shall be the reponsibility of winner unless speifically noted in the raffle description.
Claiming a Weapon. When the prize is a weapon or other item that has federal or SC state law for transportation and delivery, the delivery of the prize shall be in accordance with the federal and/or state requirement. Winner will be required to provide documentation to AEF or its agents to facilitate conformance with federal and/or state law.
Winners Release: Entrant agrees that if he or she is selected as the potential winner, regardless of whether or not he/she is qualified as the winner, that AEF, and each of its designees, (a) shall have the right and permission to use (unless prohibited by law) entrant’s name, voice, address (city and state of residence), photograph and/or other likeness for advertising, promotional and/or trade and/or any other purpose in any and all media or format now known or hereafter devised throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification to entrants or any third parties; and (b) shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize (including any travel or activity related thereto) and/or AEF will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural or man-made disaster outside their control that may cause the cancellation or postponement of any game(s), event(s), or exhibition(s), or travel and/or lodging provisions, if applicable, or the inability of AEF to deliver any or all of the prize items.
REQUIREMENTS OF THE POTENTIAL WINNER: Except where prohibited, the potential prize winner may be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) and IRS Form W-9 within fourteen (14) days of being notified. If the potential winner fails to sign and return the Affidavit/Release within the required time period, AEF will close the raffle and the unclaimed prize will not be awarded.
Disqualified Winner: If AEF, in its sole determination, disqualifies a winner, the winner will not be entitled to any refund of any kind. If the winner is disqualified for any reason, an alternate winner will be selected from the remaining Digital Tickets until such time as a qualified winner has been selected. Once a qualified winner has been selected, if AEF, in its sole determination, determines that there is not enough time for the winner to claim and receive all, or some, of the prize items, AEF may, in its sole discretion, replace all or a portion of the prize items with other prize items of similar or greater value, or with a cash payment. In no event, will any such cash payment exceed the Fair Market Value of the prize package.
Cancelation of a Raffle. AEF may cancel a raffle if in the sole discression of AEF a sufficient number of raffle tickets have not been sold within a prescribed period of time. In general, one third of the listed number of raffle tickets are required to support the overhead and cost of raffle prizes. AEF may choose, at any point during the course of a raffle that the required number of raffle tickets are not reasonably expected to be sold. In the event AEF decides to cancel or terminate a raffle all raffle ticket purchases will be refunded and the raffle will be terminated at the sole discretion of AEF.
Jurisdiction: The entrant acknowledges and agrees that this Raffle is being conducted exclusively in the the State of South Carolina and that all issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions or Official Rules, or the rights and obligations of the entrant, AEF, and the Released Parties, in connection with the Raffle, shall be governed by and construed in accordance with the substantive laws of the state of South Carolina, USA.
Privacy. AEF will not disclose, share, sell or distribute the names or any information shared in the raffle entry process with any outside party for any reason, beyond that necessary to enter the raffle and select a winner for the raffle. The winner(s) of the raffle will grant certain rights to AEF as is outlined herein.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Raffle, entrants agree to release and hold harmless AEF, its managers, governors, affiliates, employees, Directors, sponsors and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Raffle, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Raffle; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Raffle or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Raffle or acceptance, receipt use or misuse of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Raffle, and in no event shall the Released Parties be liable for entrant’s attorneys’ fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages. AEF is not responsible if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
Sponsors and Sponsorships. AEF may partner with Sponsors on raffles. If a raffle prize is sponsored, that information will be listed on the raffle page.
Administration. All raffles are administered by AEF and will not be administered by an outside party, beyond the use of rafflecreator.com and their roll is selling raffle tickets.
Raffle RESULTS: To find out the name of prize winners after the conclution of a raffle, Entrants who are not winners can send a self-addressed stamped envelope and
a short note listing which raffle you are wanting the results to:
